1. Acceptance of Terms

By accessing and using the ArtsED West website and services, you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Organization Mission

ArtsED West is a 501(c)(3) nonprofit organization dedicated to ensuring equitable access to high-quality arts education across the Western United States. Our services include professional development, teaching artist certification, consulting, and policy engagement.

3. Use of Services

3.1 Educational Programs

Our educational programs and professional development services are designed for educators, teaching artists, and arts organizations. Participants must register and pay applicable fees as outlined in program descriptions.

3.2 Certification Programs

Teaching Artist Certification programs have specific requirements and standards that must be met. Certification is granted upon successful completion of all program requirements and is valid for the period specified in the certification documentation.

3.3 Consulting Services

Consulting services are provided under separate agreements that detail scope of work, deliverables, timelines, and fees. These agreements supersede these general terms for the specific services covered.

4. User Responsibilities

• Provide accurate and complete information when registering for programs or services
• Maintain the confidentiality of your account credentials
• Comply with all applicable laws and regulations
• Respect intellectual property rights of ArtsED West and other users
• Use services only for lawful educational and professional purposes

5. Intellectual Property

All content, materials, curricula, and resources provided by ArtsED West are protected by copyright and other intellectual property laws. Users may use these materials only as authorized by ArtsED West and may not reproduce, distribute, or create derivative works without written permission.

6. Payment Terms

Payment for programs and services is due as specified in program registration or service agreements. We offer sliding scale pricing for qualifying organizations and individuals. Scholarships may be available based on need and availability of funds.

7. Cancellation and Refund Policy

Program cancellations made more than 14 days before the start date are eligible for a full refund minus a $25 processing fee. Cancellations made 7-14 days before are eligible for a 50% refund. No refunds are provided for cancellations made less than 7 days before program start.

8. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We are committed to protecting your personal information and using it only for the purposes outlined in our Privacy Policy.

9. Limitation of Liability

ArtsED West provides services on an "as is" basis. While we strive for excellence, we cannot guarantee specific outcomes from our programs. Our liability is limited to the amount paid for the specific service in question.

10. Indemnification

You agree to indemnify and hold harmless ArtsED West, its officers, directors, employees, and partners from any claims, damages, or expenses arising from your use of our services or violation of these terms.

11. Modifications to Terms

ArtsED West reserves the right to modify these terms at any time. Changes will be posted on this page with an updated effective date. Continued use of services after changes constitutes acceptance of modified terms.

12. Governing Law

These terms are governed by the laws of the State of Arizona. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
